The importance of Wills in identifying relationships is often
necessary to document relationships such as marriages when no other
document is available. This Will confirmed the marriage of two brothers
David and Peter Weatherwax to two sisters Helena, and Catharina
Cipperly/Sipperly. No other marriage record has yet been found for them.
Since neither David or Peter could write no family Bible record has
been found to confirm this relationship. What is known is both families
were in fact Palatines arriving in 1710, and both families originally
settled in East Camp (Present day Germantown NY . So this Will is a
legal document confirming the marriages of these two couple..
Will of Michael Cipperly of Schaghticoke, probated 3 May 1791.
In the name of God Amen. I, MICHAEL CIPPERLY of Schaghticoke, County of
Albany and State of New York, being weak in Body and of great age but
of sound and perfect memory (Blessed be the Almighty for the same), do
make this my last will and testament in the manner and form following.
First I deliver my soul to the Almighty God from whence it came and my
Body to the Earth to be buried in a decent and Christianlike manner.
As for my worldly affares [sic] and state which the Lord had Blessed me I bequeath in the form following (that is to say)
First I give and bequeath to my beloved son JACOB CIPPERLY and beloved
daughter CATHARINE WEATHERWAX, wife to PETER WEATHERWAX all the land and
tenements that I now am the owner of, to be divided equally between
them after my Decease and the decease of my wife REGINA CIPPERLY.
Secondly I give and bequeath to the rest of my children the following
sums of money to be paid to them one year after mine and my wife's
decease by the above mentioned two of my Children, Jacob Cipperly and
Catharine Weatherwax in the manner and form hereafter prescribed - to my
beloved son BARENT CIPPERLY they are to pay the sum of one hundred
pounds equally between them the sum of ten pounds per year and after the
expiration of ten years if not paid or any part thereof with lawful
interest till paid.
Thirdly I give and bequeath to my son JOHN
CIPPERLY the sum of one hundred pounds in the same condition and terms
aforesaid to Barent -
Fourthly I give and bequeath to my son HENRY CIPPERLY to be paid in the same manner and form aforesaid.
Fifthly I give and bequeath to my daughter SUSANNA the sum of one
hundred pounds to be paid in the same manner and forms aforesaid.
Sixthly I give and bequeath to my daughter HELENA wife to DAVID
WEATHERWAX the sum of one hundred pounds to be paid in the same manner
and form aforesaid and also one brass kettle.
Seventhly I give
and bequeath to my daughter MARY BARBARA the sum of eighty pounds which
[--?--] I have against her husband CHRISTIAN FRANKLIN.
Eighthly I give and bequeath to PHILLIP CIPPERLY twenty shillings after my decease.
Ninthly I give and bequeath to my granddaughter REGINA CIPPERLY twenty shillings to be paid after my decease.
Tenthly I bequeath all my [blacksmith's tools?] to my son JACOB CIPPERLY.
Eleventhly I give and bequeath to my son BARENT CIPPERLY the sum of four pounds out of my personal estate after it is divided
Lastly I give all the remainder part of my estate to all my children to
be equally divided between them after my decease and the decease of my
wife except for my son PHILLIP CIPPERLY and my granddaughter REGINA
CIPPERLY, they shall have no more than the twenty shillings I have
willed to them.
I hereby nominate and appoint my trusty and
loving friends JOHN SNIDER and JACOB WEATHERWAX executors of this my
last will and Testament revoking hereby all former wills by me made,

First I direct my Executor herein named to pay out of my estate my lawful debts and funeral expenses.
Second I give devise and Bequeath unto my brother James F. Wetherwax two thirds of all of my property, and unto my nephew James H. Wetherwax one third of all my property.
Third I hereby appoint James F. Wetherwax to be my executor of this my Will & revoke all former Wills.

Great new on Ancestry.com.
They have begun posting Wills and Probate records on their website.
This is a great resource for searching family history. A quick check
this morning revealed many states now available, not all yet fully
indexed. I did a quick search and ended up with about 50 pages of Wills
and probate records to add to my database. Many were in far away states
in the West where I would never get to local records to check. These of
photo and microfilm images of original
documents so are a primary source. Also remember to use the various
spelling variations not just Weatherwax! i.e.
Wetherwax,Witherwax,Weatherwalk,Watherwax etc.
For me the good news was finding the Probate file of J.D. Weatherwax in MT. This files confirms my belief that J.D.,s son Edward T. Weatherwax failed to mention or include J.D. Weatherwax's native wife Tailfeather Woman and their Blackfeet children as lawful heirs to his estate, but claimed the whole estate for himself and his brother. Not being a lawyer I dont know if this was legal at that time (1887). Also be aware many of these files have numerous documents, some as few as one or two. So you will have to go through and select the most pertinent ones to use.

For
those of you who are using the Social Security Application and Claims
index a word of caution!. Be careful and make doubly sure that the data
listed on the right side of the screen i.e. SSDI ,US Census citations
etc is an exact match. I have found many individuals with the same given
name have the wrong Census or SSDI citation attached. Just proceed with
caution. There were over 600 hits when I searched this DB just using
the spelling WEATHERWAX, no other variation that was 35 pages of family
members etc. I am just over half way with 12 more pages to verify. This
is still a solid effort many missed dates,missed children, maiden names
etc have appeared using this tool, as well as data on parents of those
who married a Weatherwax family member.

Ancestry.com
has placed online the SSACI Social Security Application and claims
Index 1936-2007. Unlike the old SSID (Death index) this new index
includes any claim made to Social Security such as : name change due to
marriage, name of parents,name at application for SSAN, name at death
etc.. This is proving to be an excellent source for maiden names,parents
names DoB, DoD etc. Be aware however that not everyone will appear only
those who made a claim or application of submitted a name change etc

Weatherwax family
ancestral land search in Rensselaer
County New York.
Previous research by Arthur Johnson a descendant of Isaac
Johnson husband of Betsey Weatherwax identified the location of the Land
purchased by Andreas (Andrew) Weatherwax in 1765 as lying under the
existing Tomhannock Reservoir in
Rensselaer county NY.
This research is not supported by sources in Johnson's
limited published work. He only sites several geologic maps without reference
to why they were selected.. There is little or no correlation with the Known
published Will of Andrew Weatherwax (the immigrant's son) or known locations
and deed of other family members
The Will of Andrew Weatherwax probated in 1784 and found in
Fernow's Calendar of Wills states the following regarding the disposition of
lands and deeds granted to his children.
1. "To my son
Hannes- 231 &3/4 acres of land wheron he now lives in Tamhanick."
"He having a deed for the land from me already."
2. "To Martin
Widderwax- the farmhouse whereon I now dwell in Tamhanick at the extent of
a farm surveyed for Alexander Widderwax containing 235 & 1/2 acres."
Although Andrew's Will gives further disposition of lands to
his other children these two provisions of the Will provide sources that lead
to the identifying the current location of the lands in Question.
Clearly based on #2 Martin Widderwax (Weatherwax) inherited
his father Andrew's farm of 235&1/2 acres of land. Subsequent land records
will show the location of this property today.
It must be remembered when doing land searches in New York
that most land was in one huge county called Albany county. Rensselaer County
NY was not broken off from Albany county until 1792. So when researching land
that was purchased or deeded prior to 1792 the Land records of Albany county
must be consulted to provide a continuous chain of ownership for lands being
searched.
Hannes Widderwax
(Weatherwax)
Johannes or Hanes Weatherwax was the first born son of
Andrew Weatherwax by his 2nd marriage to Jo Anna Edeli. His exact date of birth
is not found, but other documentation indicates a dob of 1740. He married Anna
Premmer abt 1761. He died 11 Mar 1818 in Schaghticoke, Rensselaer co. NY. He
had seven known children. The son Andrew Weatherwax b:9 Sep 1766 provides the
chain of land ownership from his father Hannes to Andrew's son John A.
Weatherwax b:1794. His son was John A. Weatherwax b:4 Sep 1841
Additionally the approved S.A.R. application of John P.
Weatherwax clearly indicates the land in question remained within the family until the last parcel was sold by him in 1972.
Contained in the holdings of the Rensselaer county
Historical society is the family Bible of John A. Weatherwax this Bible
provides a clear consistent line of descent to John Peer Weatherwax b:23 Sep
1904, d:28 Jun 1991. These papers containing over 15 boxes of documents, photos
and family records provide a chain of land ownership that points to the
location of this land on Weatherwax lane in present day Schaghticoke, Rensselaer
co. NY.

does not specify anything that would indicated the present day location
of the land in question.

140 acres of land located in Schaghticoke
Another Deed found Book 330, pg25 indicates that Freeman
Cooper Weatherwax and wife Edith sold some of this land to his brother William
M. Weatherwax on 22 Oct 1910.
Upon Freeman C. Weatherwax's death on 3 Feb 1953 the
remaining parcel of original land passed through inheritance to his son John
Peer Weatherwax and his sisters Louis W. Austin and Esther W. Sykes.
Utilizing the 1976 Rensselaer County New York Tax maps for the
town of Schaghticoke indicated a
parcel of property on "Weatherwax Lane" , at the junction of Gunbadt
Road. A cross reference to property sales indicated that John P. Weatherwax
sold property in 1972 A surveyed plot
map with information confirmed that the
property at this location was sold by John Peer Weatherwax and his sisters.
The Schaghticoke Tax Map #041.00 clearly indicates the property
in question and also indicates that the 10.66 acres sold was part of the
original 231+ acres of the original patent. This last parcel of land owned by
Hannes Weatherwax's decendants was sold
based on a land survey dated 26
Jun 1972 and registered on 11 Jul 1971. The land was sold to James A. and
Caroll Jennison of Schaghticoke.
This then confirms along with other documentation that
Andrew Weatherwax's purchase of 1/3 of a parcel of land encompassing 8602 acres on the East bank of
the Hudson which was transacted in 1765 was in fact located in present day
Schaghticoke, not Pittstown NY. It appears that the Northern boundary was along
Tomhannock creek. Some indications are that the patent continued southward to
the Deep Kill. In total on his death Andrew parceled out a total of about 2800 acres of land, reserving 800 acres
to pay for anything due on the whole patent.

original farm of 235 1/2 acres which was deeded to his son Martin Weatherwax 1741-1813.

bap:13 Jan 1741; d:27 May 1813.
Martin Weatherwax and his brother David Weatherwax
(1747-1831), both these brothers sold their Rensselaer county farms and moved
to Peru, Clinton county NY by 1794. Clearly in 1796 both appear in Road tax
lists for the town of Peru, Clinton co. NY. No record of the sale or transfer
of David's property has yet been found. But evidence exist based on land
purchases in Clinton co NY that both bought 300 acres farms in Peru on the
Western shore of Lake Champlain

This deed date 29 Nov
1792 clearly indicates that the
Grantor Martinus Weatherwax
Grantee: Benjamin Holt
purchased land on 185 1/2 acres on 29 Nov 1792
then on 23 May 1811
Rensselaer county deed book 5, pgs.496-497
Indicates that land in possession of Benjamin Holt is
conveyed to James Brookins.
Here it gets fuzzy because the Court of Common Pleas took a
certification of this transaction by Martin Weatherwax who was then living in
Peru NY. Possibly he traveled to Rensselaer county, but he would die within 2
years and it appears he would not have traveled that far but provided a written
certification to the court.
So further research is needed to identify the land held in
1811 by James Brookins. It is noteworthy that Peter Weatherwax 1752-1805 is
buried in the Brookins Family cemetery on NY route 41 along with James Brookins.
Peters property is rumored to be located near this site
again in Schaghticoke. It seems a reasonable assumption that the reason Peter
Weatherwax was buried in the present day Brookins Family cemetery is that prior
to the land purchase by Brookins that this was in fact a Weatherwax family
cemetery with only the tombstone of Peter Weatherwax remaining in present day.
Why else would Brookins allow Peter Weatherwax to be buried there?

J.C. Weatherwax and Constance Dixon
I am currently searching for J.C. Weatherwax b:1935. He married Constance L. Dixon in 1956 in San Joaquin co. CA. They had 3 knwon children. All references to him indicate just the initials "J.C." Weatherwax.
Constance and children may still be living. But I need to determine his Given name and middle name. Interestingly enough I think his parents are Harry H. Weatherwax and wife Rosa A. Fleming of Iowa. Anyone who can provide clues info etc I would appreciate and help.

FHL: The Weatherwax Genealogy by: James N. Fisher Jr (1972 )
I downloaded a copy of this to check against my own research. This Genealogy covers The Weatherwax family and its intermarriages with the Langdon and Menefee families.
Page: W-1 starts with Joseph C. Weatherwax b: 4 Apr 1797. The error is his place of birth cited as Germany! First Germany did not exist as a country until after 1880. Secondly all known Weatherwax's for the most part with a date of birth after July 1710 were born in NY Colony. Modern day exceptions do occur, but not in the Colonial period. This Joseph descends from the first North American born generation, specifically: Petrus Weatherwax (1752-1805) and wife Catharina Cipperly (Zipperle) (1755-1837). He was born in Schaghticoke, Rensselaer co NY. His father owned a farm there. He married Catharina Grauberger (1801-1884) who was from another Palatine family arriving in 1710. He migrated to Schoharie county NY abt 1824 where he married his wife Both are buried in Slate Cemetery, Schoharie co NY. A good deal of this Genealogy addresses the LANGDON and MENEFEE families. No sources other than personal correspondence is cited.

Frank P. Harvey (1878-1958) married Hattie Belle Weatherwax (1887-1942). Today while verifying Michigan death records I discovered they had an infant son Maxwell Frank Harvey b:6 Jul 1921 in Waverly,Van Buren co MI. Died 8 Jul 1921 and buried in Robinson Cemetery Gobles,Van Buren co MI. This son does not appear on any USC record you must use MI death records to find him. When I went to Find A Grave there was no maker for this son. His parents are there in Robinson Cemetery Van Buren co MI, but not indication of this son. So if you are researching this HARVEY line or the line of her parents: Clement S. Weatherwax (1862-1952) and Jessie M. Boothby (1862-1941) you need to check the websites: (seekingmichigan.com) and (Findagrave.com)

CORRECTION TO Page 314-315 of my book as follows:
I received an Email from Cheryl Dahl questioning errors she has found in the family of #875
Jacob L. Weatherwax or Wetherwax. Cheryl had recently found the estate papers of Jacob L. appointing his son John A. Weatherwax and wife Susannah Weatherwax as adminstrators of his estate on 11 Mar.1863. She also provided me with information on his DoD and burial. Find a Grave records confirm his death on 6 Jan 1863 with an age of 44years 2months and 6 days. That gives him a corrected DoB of 1819-1820. He is buried in Spring Mountain Cemetery Monroe Twp. Coshocton co OH. His tombstone indicates a possible burial of his wife Susannah Mccoy sometime after 1900.
No DoD inscription is on the stone, but in USC1900 she is residing as the Widow Sussanah MOON (sp error) with her married daughter Mary Jane Williams. After Jacobs death Sussanah married Silas Moore on 8 Jun 1865 in Coshocton co OH. They later moved to CA where he died and Susannah returned to OH to live with her daughter.
The confusion arose for me when I found Jacob L. Weatherwax in USC1870 in Portsmouth,Scioto,OH. further research this week confirmed that he was b:6 May 1816 in NY; d:11 May 1875, and is buried in Greenlawn Cemetery Portsmouth,Scioto OH. His wife was listed as Louisia , more research using death records of their children identified her maiden name as WILSON.
Based on this research and help from Cheryl the following is what the family of Jacob L. Weatherwax should be:
wife: Susannah Mccoy b:1821 OH; d: after 1900 Jefferson,Coshocton OH. Possibly buried with husband Jacob in Spring Mountain cemetery.

Various online trees and FGS do not shed a hint as to his parentage. When the snows clear I will have to go to Saratoga co NY and see what I can find.
Anyone with info on this Jacob A. Weatherwax please contact me.

Funeral arrangements: Michael W. Cox Funeral Home of Jasonville IN. Services Thursday Jan 15,2015 at Lebanon Baptist Church, Internment will be at Lebanon Cemetery in Midland,IN.
